Hawaii Rabbitry Purchase Agreement
This Purchase Agreement ("Agreement") is made and entered into between Hawaii Rabbitry ("Seller") and the Buyer. By paying the deposit required to reserve a bunny, the Buyer acknowledges that they have read, understood, and agree to the following terms and conditions. The Buyer further agrees that payment of the deposit legally binds them to the terms set forth in this Agreement.
1. Deposit and Payment Terms
1.1 A non-refundable deposit of 50% of the total purchase price is required to reserve a bunny.
1.2 The remaining balance must be paid in full at the time of pickup.
1.3 Deposits are non-refundable under any circumstances and are not transferable to another bunny.
1.4 Prices are fixed and non-negotiable, based on the specific characteristics of the bunny (e.g., color, markings, etc.).
1.5 By paying the deposit, the Buyer affirms their understanding and acceptance of all terms in this Agreement, and payment serves as legal acknowledgment and acceptance of these terms with no additional signature required.
2. Pickup and Transport
2.1 The Buyer acknowledges and agrees that the Seller operates a pickup-only policy for Oahu residents. The Buyer must make all necessary arrangements to pick up the bunny at Hawaii Rabbitry’s location on Oahu in Waianae.
2.2 Bunnies will not leave the Seller’s possession until they are at least 8 weeks old.
2.3 If a bunny is not ready by the scheduled go-home date, we will reschedule pickup accordingly.
2.4 If the Buyer fails to respond within 24 hours of the scheduled pickup time, a new date will be arranged and additional boarding fee of $10 per additional day will apply.
2.5 Bunnies not picked up on within 12 days of the initial scheduled pickup date and will be considered forfeited and may be re-listed for adoption. No payments will be refunded.
2.6 A bunny-safe carrier is required for transport at pickup.
2.7 If the Buyer is coming from another island and wishes to arrange for an airport meeting, the Buyer must contact the Seller at least 48 hours in advance. The Buyer will be responsible for all additional fees related to the meeting.
3. Shipping to Other Islands (if applicable)
3.1 If necessary, the Seller can arrange to ship bunnies to certain islands. The Buyer must contact the Seller to discuss shipping arrangements. The Buyer is responsible for all shipping fees and ensuring that proper arrangements are made for the safe transport of the bunny.
3.2 The Buyer acknowledges that the Seller’s shipping option is subject to availability and does not guarantee that shipping will be available for all islands.
3.3 In the case of inter island shipping the Buyer will be required to pay the gas fee, shipping fee, airplane safe carrier fee, and all remaining purchase fee's 24 hours before the drop off time, no bunny will be shipped without the Seller having received all the remaining balance.
4. Spaying/Neutering and Breeding Rights
4.1 Our bunnies are sold as pets only and are NOT to be bred.
4.2 Buyers are required to spay/neuter their bunny once it turns 6 months old or once an authorized veterinarian says they are mature enough.
4.3 Once a bunny is 3 months old it must be kept separate from other rabbits of opposite gender until they have had their operation.
4.4 Should accidental litters occur offspring may not be sold for monetary value or bred without breeding rights.
4.5 Unauthorized breeding or sale of offsprings from our lines will result in a $2,000 liquidated damages per occurrence.
4.6 Breeding rights are NOT included with standard purchases and must be formally approved and purchased through a separate agreement. Approval will depend on various factors, including the Buyer’s experience and the care environment they can provide.
4.7 Breeding without permission is strictly prohibited.
4.8 If a bunny is rehomed or transferred to a breeder, the original purchaser on file remains fully liable for all contract violations and applicable damages.
4.9 This policy is in place to ensure that our bunnies are never misused in backyard breeding, which often contributes to bunnies being abandoned or ending up in shelters.
5. Health, Gender, and Temperament
5.1 All bunnies are healthy to the best of their knowledge at the time of pickup.
5.2 The Buyer acknowledges that the Seller cannot guarantee the temperament, behavior, or adult size/weight of the bunny.
5.3 The gender of the bunny is checked multiple times, but the Buyer understands the bunny's gender is not guaranteed prior to 12 weeks of age. The Buyer is responsible for verifying gender and health at the time of pickup.
5.4 The Buyer agrees that handling and socialization of the bunny is the Buyer’s responsibility once the bunny leaves the Seller’s possession.
6. Return, Refund, and Replacement Policy
6.1 All sales are final once the bunny leaves the Seller’s possession, and no refunds, exchanges, or replacements will be provided after pickup.
6.2 If in the unlikely event your bunny dies in the Seller’s possession before pickup, the Buyer will be offered a full refund or the option to choose a replacement bunny of equal value.
6.3 In the event that the Buyer is unable to care for the bunny it must be returned to Hawaii Rabbitry
immediately so the Seller can ensure proper rehoming. No refunds will be provided.
6.4 The Seller reserves the right to refuse the return of any bunny that has health complications or conditions that may pose a risk to the health and safety of other rabbits at Hawaii Rabbitry. The Buyer is responsible for providing documentation from a licensed veterinarian confirming the bunny's health status if requested by the Seller.
7. Liability and Assumption of Risk
7.1 The Buyer assumes all risks and liabilities related to the bunny after it leaves the Seller’s possession, including but not limited to health, injury, or death of the bunny.
7.2 The Seller is not responsible for any veterinary bills, health issues, or injuries that occur after the bunny is in the Buyer’s care.
8. Miscellaneous Terms
8.1 The Buyer agrees to use the services of a qualified veterinarian for the care of the bunny after purchase.
8.2 This Agreement is governed by the laws of the State of Hawaii.
8.3 Any amendments to this Agreement must be made in writing and agreed upon by both the Buyer and the Seller.
Binding Agreement
By submitting payment of the deposit, the Buyer agrees to all terms and conditions outlined in this Agreement and acknowledges that they are legally bound by its terms. No additional signature is required for this Agreement to be enforceable.
